Chandigarh: High Court Dismisses Dentist's Plea

The Punjab and Haryana High Court has recently dismissed a plea by a city-based dentist, alleging that the higher authorities of police have been biased in investigating a case against the dentist by favoring the complainants. The Court remarked that it is outrageous to assume that a public servant will conduct a biased investigation to favor his familiar social circle without any valid proof.

This came after the dentist approached the high court requesting the court to keep the case of the jurisdiction of Chandigarh police.

As per a report by Hindustan Times, the dentist was booked under the charges of cheating in two different cases. In 2018, one of the complainants, who is a resident of the US, alleged cheating against the dentist. The complainant was a patient who went to the doctor's clinic in 2017 for a dental implement procedure. On the other hand, this year on 21st September, another woman also complained against the dentist. The second complainant is from Nairobi, Kenya.

The dentist alleged that the former Chandigarh Director General of Police (DGP) and former Central Bureau of Investigation (CBI) special director have been involved in the investigation of his case. But they have been known by the first complainant hence they unethically started favoring the complainant parties.

The daily further informed that the counsel for the dentist submitted that the case is brought against the doctor as a result of malice and vendetta. The petitioner added that the CBI special director was actually known by one of the complainants and hence he interfered in the investigation and conducted a biased probe.

The dentist also alleged that the first patient also instigated the second patient to bring a complaint against the dentist. Hence, the dentist requested the court to transfer the probe outside the Chandigarh police's jurisdiction or any other agency.

After receiving the submissions of both the parties, the court observed that the allegations placed against the former CBI Director are just assumptions but there is no substantial record to prove the allegations, reports the daily.

The court found that the police officer against whom the allegations were brought was never posted in Chandigarh. He only graduated with the complainant's husband from the same University in 1982; however, this cannot be the only ground to prove that there is a nexus between the high-ranking police official and the complainant.

Hence, there is not enough evidence to allege that the police officer has manipulated elements of the investigation in the favor of the complainant. Moreover, the facts that the complainant has sent the complaint on the personal mail ids of the officers or that they are friends on social media, are not sufficient evidence to question the efficiency or the unbiased nature of the investigation.

As far as the director-general of police (DGP) is concerned, he was transferred out of Chandigarh in 2018. HC dismissed the claim of the dentist that either of the police officers has been instrumental in conducting a biased investigation against him.
