C-Section Conducted On HIV-Positive Patient Without Following Due Process: Aligarh Hospital Sealed, Director Booked

Lucknow: A case has been registered against the director of a private hospital in Aligarh which was sealed by the district administration for allegedly carrying out a caesarean section on patient, a suspected HIV-positive patient, without following the due procedure
Police informed The Indian Express that the procedure was performed without following the due procedure. The hospital was also sealed by the District Administration. Following this, the patients who were admitted there were shifted to a government hospital.
An FIR has been registered against the director of the hospital under sections 269 (negligent act likely to spread infection of disease dangerous to life), 270 (malignant act likely to spread infection of disease dangerous to life), 275 (sale of adulterated drug), 417 (cheating) and 420 (cheating and dishonestly inducing delivery of property) of the Indian Penal Code was filed on the complaint of Aligarh Additional Chief Medical Officer Rohit Goyal who had conducted a preliminary inquiry into the matter.
However, Aligarh Assistant Superintendent of Police (ASP) Mrigank Shekhar Pathak informed that no one has been arrested in the case yet and the investigation is still ongoing.

As per the latest media report by Indian Express, an official informed that the district administration received a tip-off on Friday that the due process was not followed during the C-section conducted on the HIV-positive patient. After receiving the tip-off, a team of the district administration reached the hospital and discovered that none of the officials representing the hospital authorities were present there.
Further, the staff members of the hospital, who were present at the time, could not provide relevant documents regarding the patient's condition or treatment. Following this, the officials informed the State Health Department.
Due to the contagious nature of HIV, there are certain procedures that need to be followed while treating patients who are infected with the disease. had earlier reported that a video of a junior doctor became viral in which he was seen allegedly slapping and verbally abusing an HIV-infected patient at the MY Hospital.
The concerned HIV-infected patient was a 45-year-old man who was sent to MY Hospital from a hospital in Ujjain for treatment of a broken bone. The junior doctor who had initiated the patient's treatment was angry at not being told by the patient or his attendant about the HIV infection before the start of the bone treatment. In response to this, the doctor was immediately suspended from the hospital without delay.
